1. Acceptance of Terms
By accessing and using MyFamBam ("the Service"), operated by ByteSize Solutions, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.
2. Description of Service
MyFamBam provides a platform for creating, managing, and sharing family information and genealogy. The Service includes features such as family member profiles, photo galleries, Family Feed, Family Trivia, badge collection, and shared family tools.
3. User Accounts
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
4. Subscription and Payment
Some features require a paid subscription. Web payments are processed by Polar and mobile subscriptions are processed by Apple App Store or Google Play, depending on platform. By subscribing, you agree to pay the fees for your selected plan. Subscriptions automatically renew unless cancelled before renewal. You can manage or cancel from Settings > Subscription or your mobile app store subscription settings. Unless required by law or stated in a specific offer, charges are non-refundable.
5. User Content
You retain all rights to content you upload to the Service. By uploading content, you grant us a license to use, display, and distribute that content as necessary to provide the Service. You are responsible for ensuring you have the right to share any content you upload.
6. Prohibited Uses
You may not use the Service for any illegal purpose or to violate any laws. You may not upload malicious code, spam, harassment, or content that violates others' rights. We reserve the right to terminate accounts that violate these terms.
7. Termination
We may terminate or suspend your account at any time for violations of these Terms. You may cancel your account at any time from your account settings. Upon termination, your right to use the Service will immediately cease.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, or consequential damages.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
11. Disputes
If you have a dispute, please contact us first through the Contact Us form so we can try to resolve it informally. If we cannot resolve it, disputes will be handled in the state or federal courts located in New York, New York, unless applicable law requires otherwise.
